How to File for Divorce in New York

The two most important aspects of filing divorce in New York are, first and foremost, the legal paperwork in having the divorce finalized, as well as ensuring the assets are divided appropriately and equitably. Couples with children will also need to settle terms of custody and child support.

One of these minimum requirements must be met in order to file for divorce in New York:

  • Both spouses are New York residents, and the reason for the divorce occurred while in the state
  • One spouse has been a resident of the State of New York for at least 1 year, and the cause of the divorce occurred while in the state
  • One spouse has been a resident of the State of New York for at least 1 year, and the couple was married while in the state
  • One spouse has been a resident of the State of New York for at least 1 year, and the couple have been living as husband and wife
  • One or the other spouse has been a resident of the State of New York for at least 2 years

In the past, there were several actions that the courts legally recognized as contributing to the breakdown of a marriage. However, this is no longer the case. You do not need to prove that one or the other spouse is at fault for the end of the marriage. This is known as a “no-fault” divorce, and New York State designates you only need to state that the marriage has broken down to the point where you and your spouse cannot reconcile.
